Terms of Service
These Terms of Service ("Terms") govern your access to and use of the QuitMate mobile application and related services (collectively, the "Service") operated by QuitMate ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Scope of These Terms
These Terms apply to all interactions between you (the "User") and QuitMate related to the Service. Additional rules or guidelines ("Additional Terms") may also apply, and such rules shall be considered part of these Terms. In the event of a conflict, the Additional Terms shall take precedence unless otherwise stated.
2. User Registration
To use certain features of the Service, you may be required to register for an account. Registration is complete only when you (1) agree to these Terms and (2) receive approval from us. We reserve the right to decline registration for reasons including, but not limited to:
- Providing false or misleading information
- Having previously violated these Terms
- Any other reason we deem inappropriate
We are not obligated to disclose the reason for denial.
3. Account Security
You are solely responsible for maintaining the confidentiality of your account ID and password. You may not share, transfer, or lend your credentials to any third party. Any action taken using your account will be considered your own. We are not liable for any loss or damage caused by unauthorized use unless due to our gross negligence.
4. Prohibited Conduct
You agree not to engage in any of the following while using the Service:
- Violating laws or public order
- Criminal activity or supporting such acts
- Interfering with or disrupting servers, networks, or other users
- Collecting or storing personal information of others
- Impersonating other individuals or organizations
- Accessing or attempting to access accounts without authorization
- Posting content that:
- Is excessively violent or sexually explicit
- Promotes discrimination or hate speech
- Encourages suicide, self-harm, or drug abuse
- Is offensive, defamatory, or socially disruptive
- Engaging in activities aimed at:
- Promoting commercial products or services (unless approved)
- Sexual solicitation or lewd behavior
- Meeting strangers for romantic or sexual purposes
- Harassment or bullying
- Misusing the Service in any unintended way
- Religious proselytizing
- Any other behavior we deem inappropriate
5. Suspension of the Service
We may suspend or discontinue the Service without prior notice for reasons including:
- System maintenance or upgrades
- Force majeure events such as natural disasters or outages
- Technical issues with servers or communication networks
- Any other operational or security-related concern
We are not responsible for any loss or damages caused by such interruptions.
6. Intellectual Property
Users may only post or upload content (text, images, videos) to which they own rights or have proper authorization. The rights to such content remain with the user or rightful owner, but you grant QuitMate a non-exclusive license to use it for purposes such as improving or promoting the Service.
All other content and intellectual property related to the Service belongs to QuitMate or its licensors. Users may not reproduce, distribute, alter, or publicly share such materials without prior written consent.
7. Account Termination
We may suspend or delete your account without notice if:
- You violate any of these Terms
- You submit false information during registration
- Your payment method becomes invalid
- You fail to fulfill payment obligations
- You do not respond to our communications
- You are inactive for an extended period
- We determine your use is inappropriate for any reason
If your account is terminated, you will immediately lose access and must pay any outstanding amounts. We are not responsible for any loss resulting from such termination.
8. User Cancellation
You may delete your account at any time via the in-app cancellation process.
9. Disclaimer of Warranty and Limitation of Liability
We provide the Service “as is” and make no guarantees regarding its performance, reliability, or availability. We are not responsible for damages caused by:
- Bugs, errors, or service disruptions
- Unauthorized access or data breaches
- Interactions or disputes between users or third parties
To the fullest extent permitted by law, our total liability is limited to the amount paid by the user for the Service in the month the damage occurred.
10. Changes to the Service
We reserve the right to change, add, or discontinue parts of the Service at our discretion with prior notice.
11. Modifications to These Terms
We may update these Terms when necessary. Changes will be effective upon notice via email or posting within the app. Continued use of the Service after such notice constitutes acceptance.
12. Privacy
We handle all personal information in accordance with our Privacy Policy. Please review it to understand how your data is collected and used.
13. Notices and Communication
All notices and communication between you and QuitMate shall be conducted via methods we specify (e.g., in-app notification, email). Notices are deemed delivered when sent to your registered contact information.
14. Transfer of Rights
You may not transfer or assign your rights or obligations under these Terms to any third party without our written consent.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the State of California, unless otherwise required by your local jurisdiction. Any disputes shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.
